A WARWICK man who failed to carry out unpaid work he had been ordered to do after crashing his Range Rover onto a bike rack outside a supermarket has been re-sentenced.
But Nathan Turpin again escaped being jailed after a judge heard his mental health problems meant he was not able to do the work, but had not provided evidence for his absences.
The 40-year-old, of Shakespeare Avenue, appeared at Warwick Crown Court after he admitted failing to comply with a 12-month community order imposed earlier this year for offences in Devon.
Under the order, imposed at Exeter Crown Court in June for driving with excess alcohol and affray, he was ordered to take part in a rehabilitation activity and to do 80 hours of unpaid work.
But Warwick Crown Court heard that since then he had failed to attend supervision and unpaid work appointments in September without providing an acceptable reason.
Prosecutor Ben Williams said Turpin had admitted the breach on the basis he did have a reasonable excuse for not turning up, but had failed to provide supporting evidence.
Charlotte Baker, defending, explained that Turpin, whose mental health problems were significant, had been signed off any form of work by his GP, and there had been seven acceptable absences for which sick notes were produced.
Recorder Ben Mills revoked the order imposed in Exeter, and imposed a new 12-month community order with a rehabilitation activity and a 6pm-6am curfew for eight weeks, and ordered Turpin to pay £50.
